Construction

Mateer Harbert's construction law department, which is comprised of several attorneys (one of whom is a registered architect), practices in all areas and phases of construction law. We routinely represent owners, developers, construction managers, sureties, architects, engineers, general contractors, subcontractors, and material suppliers. The firm's construction law practice encompasses individual claims to complex comprehensive matters requiring representation throughout the entire construction process, from conception through substantial completion, including warranty periods and resolution of claims. We structure and prepare front-end contract documents, incorporating terms which minimize risk and maximize benefit for our clients. Depending on client needs, we have the ability to initially draft contracts or utilize industry documents, where appropriate.

Mateer Harbert's construction law practice involves a significant amount of litigation, arbitration and mediation in federal and state courts and before various administrative agencies. Litigation matters we have handled include bid protests, minority/women business enterprise certification issues, lien and bond claims and breach of contract claims ranging from simple to complex, multi-party construction litigation. Issues we have litigated include interpretation, differing site conditions, constructive changes, delays, acceleration and improper termination.

Our firm's philosophy in the construction law area is the same as in other practice areas. We maintain very close communication with our clients and endeavor to provide legal solutions that are cost-effective and responsive to each client's specific needs. In the litigation practice, while we frequently litigate a matter through trial, we are cognizant of the benefits in many cases of early resolution in the litigation process and we advise our clients on alternative strategies for early resolution, including arbitration, mediation and early negotiation.
