Condemnation
The condemnation and eminent domain section
of Mateer Harbert is comprised of attorneys with
over 50 years combined experience in the representation of
owners whose properties are sought to be acquired by governmental
authorities. Our counsel have handled matters involving acquisitions
by a variety of condemning authorities, including the State
of Florida, cities, counties, school boards and transportation
authorities.
We have represented owners of all types
of property, from small residential parcels to a several thousand
acre planned development to takings involving large office
buildings and hotel properties. In some cases, the objective
of our participation is to prevent the condemning authority
from acquiring the property. The ultimate objective is to
obtain full and just compensation for the client under federal
and Florida law.
We utilize a team approach to the condemnation
practice that includes our in-house experts and outside consultants
who advise in areas of appraisal, land planning and engineering.
Our attorneys who concentrate their practice in the area of
representation of property owners are able to draw on the
expertise of other practice areas of the firm, including land
use law, environmental issues and tax planning. Our attorneys
are experienced not only in trial advocacy, but also in the
skills of mediation and negotiation. In addition, our attorneys
are experienced in appellate advocacy and are able to handle
any type of appeal, when necessary.
Florida law generally requires the condemning
authority to bear the cost of a client's attorney and outside
consultant fees. Accordingly, the terms of our representation
prove to be very cost effective for our clients.
